Marathon Gear Up Sweepstakes Presented by the Oregon Army National Guard Official Rules and Eligibility Requirements

1. Each entrant in the Gear Up Sweepstakes Presented by Oregon Army National Guard (the “Giveaway”) must be a legal resident of the United States and 18 years or older as of September 6, 2024.
2. No purchase is necessary to enter or win the Giveaway and no purchase will enhance the chances of winning.
3. To enter the Giveaway, the entrant must fill out the entry form on the Portland Marathon website at Portland Marathon by OHSU Health. Additional entries may be obtained by following @oregonarmyguard, following the Portland Marathon on Instagram @pdxmarathon, and by following the prompts detailed in the caption of any of the four social media posts which will be shared on the Portland Marathon’s Instagram and Facebook accounts featuring the giveaway. Entrants are allowed one entry through the initial entry form on the Portland Marathon website and an unlimited number of entries through additional entry methods.
4. The winner of the giveaway will be contacted by email and announced on social media on or around September 30, 2024.
5. The giveaway will begin on September 10, 2024, at 12:00 AM and conclude on September 13, 2024, at 11:59 PM.
6. Only one winner will be selected. The winner will be selected by random selection on October 1, 2024, and contacted via email on or around October 3, 2024. Sponsor shall have no liability for a winner’s failure to receive notices due to winner’s spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 72 hours from the time award notification was sent, or fails to timely return completed and executed declarations, affidavits, tax documents, and/or releases as required, the prize may be forfeited and an alternate winner selected.
7. The winner will receive a prize package that includes one free race entry into the 2025 Portland Marathon, a Portland Marathon Brooks Jacket, a pair of GOODR sunglasses and a RAPID REBOOT REVAMP recovery sleeve. The Portland Marathon and Army National Guard reserve the right to change the prize to a different prize of the same value depending on availability. The prize is not transferable. Winner must pay any taxes incurred by accepting the prize, and provide certain tax information to the Sponsor. The receipt by winner of the prize offered in the Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
8. The entrant understands that this Giveaway is open to all residents of the United States, and that based on the anticipated high volume of entries, the entrant's chance of winning may be low. The odds of winning will depend on the number of eligible entries received.
9. The Giveaway is sponsored by Portland Marathon (the “Sponsor”), with Army National Guard as a prize provider.
10. By participating in the Giveaway, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the collection, submission, and processing of Entries and the overall administration of the Giveaway. Entrants should look solely to Sponsor with any questions, comments, or problems related to the Giveaway. Sponsor may be reached by email at: info@portlandmarathon.com.
11. Sponsor, prize provider, vendors and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies, and each of their respective officers, directors, and employees (the “Promotion Entities”), are ineligible to enter the Giveaway or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses.
12. The Giveaway is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law. The Giveaway is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, or Meta. By entering the Giveaway, each entrant fully releases and holds Meta harmless from any liability associated with the Giveaway or any prize.
13. By entering, the entrant agrees that should they win the Race Weekend Giveaway, the Portland Marathon and Army National Guard have the right to use their name, image, likeness, and statements when announcing the winner and in related marketing and publicity efforts without further compensation, unless prohibited by law.

15. Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) a virus, bug, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such case, Sponsor may select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Official Rules. Any attempt to deliberately damage any website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
16. By entering the Giveaway or accepting any prize, entrant agrees to release and hold harmless Sponsor and the Promotion Entities from any cause of action, liability, claim, damage, injury, death, or loss that may occur, directly or indirectly, whether caused by negligence or not, from (i) participation in the Giveaway and/or acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Giveaway; (v) electronic or human error which may occur in the administration of the Giveaway or the processing of entries.
17. This Giveaway is governed by the laws of the State of Utah without respect to conflict of law doctrines. As a condition of participating in this Giveaway, entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Salt Lake County, Utah having jurisdiction. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waive all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than actual out-of-pocket expenses (i.e., costs associated with entering this Giveaway), and entrant further waives all rights to have damages multiplied or increased.
